Lawyer for Criss's wife Dominic Barbara said: "I will show with documentary evidence that my client was still with her husband, trying to save her marriage, at the same time Cameron Diaz was dating Criss Angel. "I don't know if Criss Angel lied to Cameron Diaz, and I and my client don't wish her any bad publicity, but her press agent should be careful about what he says."

The wife of magician Criss Angel yesterday accused him of having an affair with Cameron Diaz, claiming their marriage broke down as soon as the TV illusionist got famous and bedded the Hollywood star.

Celebrity lawyer Dominic Barbara - who represents Angel's wife, Joanne Sarantakos - says he will now subpoena Diaz and have her testify about their romance, in state Supreme Court in Mineola, to support the spurned spouse's divorce suit on the grounds of mental cruelty and abandonment.

Angel who changed his name from Sarantakos and moved to Las Vegas after he hit the big time with his TV show "Mindfreak" - kept his wife of five years "as a secret" to increase his sex appeal to female fans, Barbara said.

The couple had a 15-year relationship, he said.

"We're naming Cameron Diaz as his lover," Barbara told the court. "We will subpoena her as soon as she comes back to New York."

Later, he said he'd had Angel tailed by a private investigator for six months.

Angel's lawyer, Elliot Weiner, did not deny the adultery allegation.

Cameron Diaz's flack did not return phone calls and e-mails.

Cameron Diaz believes that her diva-like ways and fear of commitment has caused her to miss out on big movie roles.

"There are a lot of great roles out there but you know my problem? I'm really bad at commitment,” she says.

"I just hate committing myself to anything. I'm terrible at making plans. I have no idea where I want to be. It's probably comes from me being a total spoiled brat and always getting my own way."

Cameron claims that her commitment phobia also prevents her from getting pets: "I don't even want a dog. My cat just died and I don't want another cat.

“Oh god, I've just opened another friggin' can of worms."

She will be happy to befriend Victoria Beckham when she moves to Los Angeles this summer.

The former Spice Girl made a great impression on the 'Shrek the Third' star when they met at the MTV Movie Awards last month and Cameron can't wait to welcome Victoria to the US.

Handler are working overtime to prevent any drama between Cameron Diaz and Jessica Biel at the June 3 MTV Movie Awards, where they will meet for the first time since their Golden Globe fight..

Sources revealed that Diaz and Biel are both presenting awards at the ceremony. "Everyone is determined to keep Cam and Jess far apart," said our insider. And Timberlake isn't helping by keeping mum as to how he'll walk the carpet, solo or with Biel.

"It's becoming a big deal because the girls both want very separate arrival times," said our source. "Nobody knows who Cameron is going to bring, if anyone. But if Jessica walks with Justin, Cameron will want to bring a date. If Jessica goes alone, Cam will probably walk alone. It's a mess."

The biggest stars are usually the last to walk the carpet - a position both glam gals are fighting to snag. Diaz, who is accustomed to being at the top of the A-list, wants to avoid the "humiliation" of having an earlier arrival time than Biel at the MTV event.

"Cam is used to being more high-profile than Jessica," said the source. "But now that Jessica's dating Justin, she has more leverage. Cameron's looking a little unstable lately."

Cameron Diaz was spotted getting cozy with Blood Diamond" star Dijimon Hounsou Thursday night. It looked like the perfect post-Valentine's Day date," a patron tells of the pair, who were with several other friends.

"They were totally vibing each other, lip-on-lip action," says the source. "Cameron looked so happy... Djimon followed her every move." They hit the dancefloor for Michael Jackson's "Burn This Disco Out" and Gnarls Barkley's version of "Gone Daddy Gone," says the onlooker, adding, "They were dancing really close, bodies pressed together."

A rep for Diaz says the pair are just friends. "Cameron was out to dinner with friends, they ran into Djimon and he joined them for a drink at Hyde," says the rep. "They are friends, nothing more."

A rep for Hounsou did not return calls for comment.
